United States' Unlawful Internet Gambling Enforcement Act Delayed

The mandatory compliance date for the regulations of the UIGEA, which came to life as midnight rules earlier this year by the outgoing Bush administration, will likely be postponemented six months, according to several high-profile sources in the business. Originally, the financial services business in the United States had until December 1st to come into line with the 2006 law. Now, that date appears to be June 1st, 2010.

No official comment from U.S. Treasury Secretary Timothy Geithner (pictured at left) or Federal Reserve Chairman Ben Bernanke had been released at press time. Interactive Media Entertainment and Gaming Association Chairman Joe Brennan told PocketFives.com, “I’m surprised because normally it's unusual for the Treasury to do this. Regardless of whether it was the Poker Player Alliance's pressure, the banking business's pressure, or Congressman Barney Frank's pressure, it’s encouraging to see. It's the first time you could say that things have stopped going against the business here in Washington, DC.”

The PPA, the poker business’s main lobbying force, was among several groups that authored letters to Bernanke and Geithner urging that the mandatory compliance date for the UIGEA regulations be pushed back until December 1st, 2010. Others who chimed in included the National Thoroughbred Racing Association, the American Greyhound Track Operators Association, and members of Kentucky’s Congressional delegation, which feared that overblocking of legal online USA casino gaming transactions could stunt online wagering on horse racing. In New Hampshire and North Dakota, overblocking led to denial of legal online lottery purchases.


Sources famed that final confirmation of a six-month postponement had not yet been released. Given the December 1st deadline, Geithner and Bernanke had until next Tuesday to issue a formal statement. On Thursday, residents of the United States will celebrate Thanksgiving, leading to a possible announcement coming on Friday or Monday. No timeline was available at press time.

On Thursday, December 3rd, a hearing at 10:00am ET in Room 2128 of the Rayburn House Office Building will see discussion of HR 2266 and HR 2267. The former postponements the compliance deadline of the UIGEA regulations by one year to December 1st, 2010, although whether it will still be discussed given today’s news of a six-month extension is not yet known. HR 2266 has 53 co-sponsors on both sides of the aisle and is the brainchild of Frank, who introduced the measure in May.

On the same day six months ago, Frank introduced HR 2267, which establishes a full framework for online USA casino gaming companies to solicit U.S. business. HR 2267 is up to 63 co-sponsors and has the full support of business organizations like the PPA. When the UIGEA was approved three years ago, the new law drove some online poker sites out of the market entirely. The publicly traded companies Party Gaming and Sportingbet own the two sites, respectively; both can be found on the London Stock Exchange.

When the six-month extension expires, an option for an additional postponement appears to be part of the plan as well. June 1st will mark the end of six months. Then, the country will be immersed in the 2010 elections, which will take place in November.

Bill Lifting United States Casino Gambling Online Ban Seen Raising $42B In Revenue

Rules that would enforce a United States ban on online casino gambling

Rules that would enforce a United States ban on online casino gambling in two months should be delayed by a year.

United States lawmakers have urged regulators to delay by a year financial rules that would enforce the ban on online casino gambling, due to be implemented from the start of December.

Enforcing the rules in two months’ time would put an unreasonable burden on regulators and the financial services industry at a time of economic crisis, stated the lawmakers, in a letter to the Treasury Department and the Federal Reserve.

The bill, which has cost European online casino gambling companies billions of Euros, prevents firms from accepting credit cards, cheques and electronic fund transfer payments in connection with any any "unlawful" online casino gambling.

Congress passed the anti-gambling legislation in 2006, when Republicans still controlled both the House and the Senate. However, the Bill did not define which types of gambling were illegal. The Treasury and Federal Reserve expressed concern a year ago that they were struggling to understand exactly what was unlawful. For example, the bill still allowed online horserace betting permissible under the Interstate Horseracing Act of 1978.

The group, led by Barney Frank, the United States House Financial Services Committee Chairman, stated in a letter that the law enacting the new rules is "flawed" and stated the House is likely to move legislation that would officially delay the rules until December 2010.

"We also believe this is an unreasonable burden on regulators and the financial services industry at a time of economic crisis," the letter signed by 19 lawmakers stated.

United States Federal Agents seize more Gambling related accounts

The Baltimore City Paper reported that "As recounted in court documents made public yesterday in Maryland's U.S. District Court, federal authorities seized the contents of six Wachovia Bank accounts held by a company called Forshay Enterprises, Inc., saying the accounts hold USA casino gambling proceeds involved in money laundering. The move follows nine other USA casino gambling-related bank-account seizures filed in Maryland in July and August, six against accounts held by a company called Electracash, Inc., and the remaining three held by HMD, Inc.

"The affidavits supporting the seizures of all 12 accounts are under seal, so the nature of the investigation behind them remains secret. For several years now, however, the Federal Agents in Maryland have been pursuing alleged money laundering in the internet-USA casino gambling realm, and last year filed charges against two men, Edward Courdy and Michael Garone, said to be tied to the online USA casino gambling titan Bodog, owned by Calvin Ayre, a Canadian living in exile.

"Public documents available in the Maryland-based Bodog investigation show the lead investigative agency to be the U.S. Internal Revenue Service Criminal Investigations Division, whereas in the recent bank-account seizures, U.S. Immigrations and Customs Enforcement (ICE) law enforcers are submitting the court filings. Most of the accounts seized are located in California cities near Los Angeles (La Habra, Anaheim, and Long Beach), though one is in Cherry Hill, N.J., and another in Sioux Falls, S.D.

"The most recent seizure case, which was made public on Sept. 23 on the federal courts online service, PACER, involved the six Wachovia accounts in the name of Forshay Enterprises. U.S. District Court magistrate Judge James Bredar signed the warrant on Aug. 28, based on a sealed affidavit provided by Richard S. Gunn, an Anne Arundel County police detective and ICE task-force officer, who requested the Forshay account seizures, court documents show..."

New Push for United States Online Casino Gambling Regulation Bill

The Safe and Secure Online Casino Gambling Initiative has launched a new advertising campaign designed to spur the United States Congress to action with the goal to fully legalizing and regulating online gambling in the United States.

There are currently three bills in Congress addressing the issue, two in the House of Representatives (introduced by Barney Frank and Jim McDermott) and one in the Senate (introduced by Robert Menendez).

But progress on all three remains slow, as the United States Congress spends its time on admittedly larger issues such as health care and financial reform.

The campaign, formally in support of Frank’s Internet Gambling Regulation, Consumer Protection and Enforcement Act of 2009 (H.R. 2267), attempts to re-catch lawmakers’ attention by addressing the fact that the nation stands to take in a lot of revenue if online gambling were to be taxed.

The United States could "collect up to $62.7 billion in new revenues for the federal government in the first decade" of full regulation, the group said in a news release.

"As Congress searches for ways to pay for health care reform and other worthy programs, it should end the unsuccessful prohibition of Internet gambling and start collecting taxes on the billions in revenue currently lost to unlicensed, offshore gambling operators," Jeffrey Sandman, the Safe and Secure Internet Gambling Initiative’s spokesperson, said in the release.

Nevada, USA prepared for online casino gambling

Nevada, USA , where declining gaming and sales tax collections have ravaged the biennial budget, could benefit financially if a bill to legalize Internet gambling in the United States is approved by Congress.

The potential, however, rests on a big IF.
A House of Representatives resolution was introduced in May that would establish a framework to permit licensed online casino gambling operators to accept wagers from inside the United States.

Legal experts said Nevada, USA has the statutory structure in place to investigate and license online gaming companies. Also, Nevada, USA could become the premier American jurisdiction for hosting Internet casinos.

If the sites were to operate from Nevada, USA , gaming regulators said the online businesses would have to pay upfront fees. Also, the online casinos would be taxed at the same rate as Strip casinos, now 6.75 percent on gaming revenues.

Again, a big IF because the keys to the whole deal rest with the 111th Congress some 2,500 miles to the east in Washington, D.C.

Federal lawmakers have focused attention on health care reform, the nation's economic crisis and other matters, setting aside issues such as Internet gambling.

"(Debate on the bill) probably won't happen this year," said former Sen. Richard Bryan, an attorney with Lionel Sawyer & Collins, who spent 12 years representing Nevada, USA in the U.S. Senate as a Democrat.

"My sense, however, is that there is a gathering, gradual momentum where, eventually, Internet gaming will occur and be regulated," Bryan said. "I'm just not sure if it has reached critical mass yet."

Lack of action hasn't stopped interest in the subject.
Bryan and fellow Lionel Sawyer & Collins attorney Greg Gemignani said the firm has been approached by potential clients who want to set up Internet gambling businesses in Nevada, USA should the activity be legalized.

Nevada, USA lawmakers enacted the process to license Internet gaming in 2001 but the state's effort went dormant a year later when there wasn't any action on the federal level.
If Internet gaming is legalized under the current bill in Congress, Nevada, USA could be chosen by the Department of Treasury to determine whether an applicant is suitable for federal gaming licensing.

BENEFITS TO Nevada, USA
Observers believe Nevada, USA , which legalized casinos in 1931, stands to benefit because the state has investigated and licensed gaming companies and regulated the industry longer than any other jurisdiction.

"The suitability requirements under the current bill look like a subset of what Nevada, USA already requires," Gemignani said. "Given Nevada, USA 's current laws permitting interactive gaming licensing, Nevada, USA is well-placed to be at the forefront of regulating online gaming and providing assistance to the federal government in determining the suitability of applicants."

Gaming Control Board Chairman Dennis Neilander said the state's current regulatory structure could be enhanced with regulations covering online casino gambling. Under the state's 2001 law, the Nevada, USA Gaming Commission could set policy that mirrors federal regulations.
Nevada, USA online casinos would have to use technology that offers reasonable assurance that wagers would not be accepted from states where Internet gambling is prohibited and that minors could not access the sites.

"We have the enabling legislation in place that would allow us to go forward with the concepts that I've heard are being discussed," Neilander said. "The federal government would set a baseline standard of minimum requirements. It would be up to individual states to opt in."
Under the state's law, Nevada, USA could earn upfront fees, which could be larger than normal licensing fees.

"We would contemplate going forward with a gaming tax that would be the same as a bricks-and-mortar casino," Neilander said.

Rep. Barney Frank, D-Mass., is the main sponsor of House Resolution 2267, the Internet Gambling, Regulation, Consumer Protection and Enforcement Act. Rep. Shelley Berkley, D-Nev., whose district includes the Strip, was one of the bill's co-sponsors.

The legislation provides safeguards against compulsive and underage gambling, money laundering, fraud and identity theft.
It's not the first time Internet gaming has come through Congress.
President George W. Bush signed the Unlawful Internet Gambling Enforcement Act in 2006, which made it a crime for banks and other financial institutions to process transactions used in online gaming.

Bryan, who was Nevada, USA 's attorney general when Atlantic City legalized casinos, was the state's governor when gaming began to expand nationally into riverboat casino markets.

Nevada, USA 's casino industry initially opposed the growth. Eventually, the Nevada, USA gaming companies moved into new markets and fueled much of the expansion in the 1990s. In 2007, commercial casinos reported gross gaming revenues of $32.54 billion.

WAGERING ON WEB SITES
The American Gaming Association, the casino industry's Washington D.C.-based lobbying arm, estimated that Americans wagered $5.9 billion on gambling Web sites outside the United States. Those same sites took in another $21 billion from gamblers worldwide.

"I haven't taken the industry's temperature in terms of Internet gaming, but, because of the potential revenues involved, I do believe there is some momentum moving in favor of the activity," Bryan said.

Gemignani said gaming companies licensed in Nevada, USA that are interested in jumping into the online casino business would have an advantage over outside companies seeking to break into the market.

"There are a substantial number of Nevada, USA licensees with experience in the technologies, systems and management of systems that can be used for online gaming," Gemignani said.
The casino industry is split on Internet gaming. As such, the American Gaming Association has taken a neutral stance on the issue "due to the divergent views of its members," according to a policy statement.

"We don't have a public position on the bill, but we are interested observers and will continue to monitor the situation as things progress," Las Vegas Sands Corp. spokesman Ron Reese said.
MGM Mirage took a short-lived stab at running an Internet gambling site in September 2001, but abandoned the idea after 21 months. The casino, which was licensed by the Isle of Man, did not accept wagers from U.S. citizens.

MGM Mirage spokesman Alan Feldman said the company's position on Internet gaming has not changed.

"We have always felt it should be legalized, regulated and taxed," Feldman said. "There is no need to create a whole new infrastructure with government oversight because it already exists in the states."

Harrah's Entertainment is the most vocal proponent of legalizing Internet wagering. Earlier this year, the company hired a former online gaming executive to expand its World Series of Poker brand internationally and online.

Harrah's Chairman Gary Loveman has said on many occasions that Internet gaming, especially poker, should be legalized.

Slot machine giant International Game Technology owns two subsidiaries based in Europe that provide content to online casinos.

Bryan said Washington, D.C., moves at a "glacial pace." However, he said there may be an underlying effort to pass Frank's bill because states could realize much-needed tax revenues from Internet gaming.

"I believe there is probably more support for it today than there was a decade ago," Bryan said.

California, USA online poker proposal hits snag

"A bid to offer state-sanctioned online poker in California, USA took a hit Tuesday morning when the leader of the California, USA Senate shot down the idea of passing a bill in the closing month of the legislative session. Meanwhile, opponents of the idea say there is a growing movement against any action this year, and a poll commissioned by one major gaming tribe found that voters were hostile to the idea.

"The effort is led by the Morongo Band of Mission Indians, which operates one of the largest tribal casinos in California, and several card clubs. They have been circulating a five-page draft bill that would create a centralized, U.S. online poker website they would offer to online customers within California's borders. The consortium would have an exclusive right to offer online poker, but all California, USA Indian tribes and card clubs would be eligible to be members. The draft also states a so-far unspecified percentage of fees would be paid to the state.

"...On Wednsday morning, Mark Macarro, the chairman of the Pechanga Band of Luiseסo Indians, sent out a letter to leaders of other tribes stating 'Pechanga has had a standing oppose position to online poker since proposals first surfaced late last year out of concerns for the far-reaching legal, political and policy consequences of an expansion of this magnitude.' Not a CTBA member, Pechanga operates a 2,000 slot machine casino in Temecula.

"Macarro also attached the results of a survey his tribe commissioned through EMC Research. According to the poll of 802 randomly selected California, USA voters conducted August 9-13, 61 percent opposed legalizing online poker in California. I only have one question when I hear a proposal like that: how much money for the state General Fund? It's all I want to know. You know, is it two, three hundred million dollars? If it is, I'd consider it. But I think it's going to take more than four weeks to analyze that kind of proposal and the potential economic benefits..."

Online Gambling Continues to be Scapegoat in USA

In the USA, the State of Arkansas is getting ready to legalize a new lottery system. And that’s the subject of some controversy, since many officials in that state expect this lottery to launch a wave of “problem gamblers.”

In fact, that’s why the state has mandated that at least $200,000 in lottery proceeds must be dedicated to “the Department of Health for the treatment of compulsive gambling disorder and educational programs related to compulsive and education related to compulsive gambling disorder” each year.

However, according to Arkansas state Lottery Director Ernie Passailaigue (who pulls in an annual salary of $324,000 from the state lottery board), problem gambling isn’t caused by lotteries. It’s caused by Internet gaming.

“If you check with the Department of Alcohol and Other (Drug) Abuse Services (DAODAS) in South Carolina, who administer the gambling program in South Carolina, they’ll tell you most of the problems are Online Gambling,” Passailaigue said in an article posted in the Arkansas News.

But that’s not true, the article goes on to comfirm. Christopher Reid, an employee of South Carolina’s gambling services , said, “We have had some calls that come in in relation to Online Gambling, but not too many.” So what are the problem gaming calls about? “Mainly the lottery,” he said.

Another clear illustration why politicians in the USA may not be ready to legalize online casino gambling: It’s too convenient a scapegoat on which to blame all other problems.

But Gambling observer Ryan Costigan says the move may signal positioning to attack the immense USA market when a multitude of legislative and judicial measures bring about licensing and regulation of online casinos by the US.

"If these companies continued to pay the exorbitant UK tax, they would be unlikely to find a profit in the USA after adding likely USA taxes," said Costigan.

Betfair may be the next Internet gambling operator to desert, saying recently it has no plans to leave the UK, but noting its extreme dissatisfaction with the leg up its competitors just acquired.

New Online Poker Gambling Bill in United States Senate

New Jersey Democrat Robert Menendez has just introduced into the UNITED STATES Senate a brand new piece of legislation designed to legalize and regulate Online poker.

"To amend title 31, United States Code, to provide for the licensing by the Secretary of the Treasury of Internet poker and other games that are predominantly of skill, to provide for consumer protections on the Internet, to enforce the tax code, and for other purposes," the bill begins.

The bill would establish a new legal regulatory framework for USA Online Poker, and also put in place certain consumer protections such as age restrictions. Officially entitled S.8309, the Internet Poker and Games of Skill Regulation, Consumer Protection, and Enforcement Act, it was introduced today.

No matter what success this bill meets with, it represents another huge milestone in the nationwide struggle to reclassify poker from gambling to a game of skill. This movement seeks to enable online poker to be not only legalized but also change the way it is regarded in popular culture.

That movement has gained a lot of transaction over the past year, with smaller court victories in states such as Colorado, Pennsylvania, and South Carolina, and with Representative Barney Frank’s recent efforts to legalize and regulate certain sectors of online gambling with his own legislation (which is separate from this bill).

Home to the original UNITED STATES gaming resort destination, Atlantic City, New Jersey has long had its own internal struggles regarding the legality of gaming, and has recently clashed with the federal government on this basis. So it makes sense that the author of this new legislation is is from New Jersey — and a Democrat, the party that is apparently more open to the idea of fully legalized online gambling. (Although it technically has bipartisan support, the vast majority of supporters of Barney Frank’s recent pro-Internet gambling efforts have been Democrats.)

Goldman Sachs Predicts US Online Casinos Will Be Legalized

In Goldman Sachs latest notice to investors, it has been predicted that the United States will legalize and regulate the online casino gambling industry. It is another example of how a growing number of people believe the legalization of Internet gambling is inevitable.

Representative Barney Frank has introduced two pieces of legislation regarding online gambling. The first would be to postpone the rules from the UIGEA from going into effect in December.

The second is the more intriguing Bill for online casinos. The legislation calls for legalization and regulation of online gambling in the US. Frank has tried before to overturn the UIGEA, but his latest effort appears to have much more support, and people are taking notice.

"We believe it is logical to assume that the United States market will eventually regulate," wrote Goldman Sachs in a notice to investors today, "given the potential implications forUnited Statestax take, if nothing else."

There is a strong possibility that online poker is legalized in several states before the federal government makes any changes to their laws. Frank's House Finance Committee is focusing their attention on the economy, so the Internet gambling debate has been delayed until at least September.

Even with the delay, Frank insists that the legislation will be passed, and suggests that USA casino online players be patient. Online poker players received a jolt a couple of weeks ago when theUnited Statesgovernment seized bank accounts that held money for United States player payouts.

Support grows for United States Casino gambling

Rep. Barney Frank sees the odds improving for repealing a long-sought Internet United States gambling ban.
The chairman of the House Financial Services Committee believes the recent seizure of millions of dollars in
online poker receipts only strengthens his hand because it reminds voters and politicians how sweeping — and potentially unclear — the existing law is.
"It helps," Frank said after the U.S. attorney for the Southern District of New York seized, or froze, $34 million in bank accounts belonging to 27,000 online poker players.
The eloquently acerbic Massachusetts Democrat will spend the bulk of this year helping the Obama administration reregulate Wall Street in response to last fall’s financial collapse. But he also wants another crack at rewriting the ban on Internet United States gambling.
Even his Republican counterpart, who led a charge last year to defeat legislation gutting the law, believes Frank is holding much better cards in the current Congress than he had in the last one.
"It’s going to be an uphill battle to stop it this time," said Alabama Rep. Spencer Bachus, the ranking Republican on the Financial Services Committee and a longtime United States gambling opponent who calls the pastime the nation’s "fastest-growing addiction."
"We caught them off guard last time," he said. "This time, they won’t be off guard."
The question is how far Frank wants to go in rewriting the current law. Banks, credit card companies and other financial institutions he oversees are asking Congress for more clarity in how to police the current ban, since they bear the onus for blocking payments to United States gambling websites overseas.
Frank, though, introduced legislation last month that goes much further. It would create a licensing and regulatory framework that would allow Americans to play poker and place other bets on government-approved websites — an ambitious proposal that could eventually generate billions of dollars in much-needed revenues for states or the
federal government.
Whatever path he pursues, any rewrite faces stiff resistance in the Senate from Jon Kyl, the Arizona Republican who worked for years to enact the current law.
It has a long, sordid past on Capitol Hill. An Army of well-funded
lobbyists — led, in part, by Jack Abramoff — overcame the pleas of Christian conservatives to repeatedly block it. Authors made a string of critical concessions over the years, and Congress approved the Unlawful Internet United States gambling Enforcement Act in 2006 after then-Senate Majority Leader Bill Frist (R-Tenn.), in a nod to the Christian conservative voters he was courting for a potential White House bid, quietly attached the legislation to a must-pass port security bill right before leaving office.
Last summer, Frank tried to pass a bill requiring the Treasury Department and the Federal Reserve to define explicitly what types of United States gambling are not sanctioned under the ban, after financial firms argued that the current law remains too vague and difficult for them to enforce. But a late surge of opposition resulted in a deadlock that forced Frank to abandon his bill.

The Illinois state Senate overwhelmingly voted Wednesday to legalize video poker, boost liquor taxes and allow lottery wagering over the Internet to help support a $26 billion statewide construction package that is expected to reach Gov. Quinn's desk.

What would be the first public works program in a decade passed the Senate on a series of bipartisan roll calls and would, according to Sen. Kirk Dillard (R-Hinsdale), end a "decade of decay" that festered on the state's roads, bridges and public buildings under impeached ex-Gov. Rod Blagojevich.

The gridlock we've been going through for six years has ended,' said Senate President John Cullerton (D-Chicago), who carried the package, which taps a combination of federal and state money.


The House still must sign off before it goes to Quinn, but Cullerton predicted House passage today.
"To pay for it, senators voted 47-12 to legalize video poker in bars, restaurants, veterans halls and truck stops. The state will tax the machines at a 30 percent rate, raising $375 million annually.

The package includes big changes at the state lottery. A pilot program would be established in 2010 to allow lottery wagering over the Internet. Additionally, management of the lottery would be turned over to a private firm. Both moves are expected to raise $150 million annuall

USA Online Gambling Bill could get a shot

Rep. Barney Frank might have come up snake eyes in his previous efforts to legalize online casino gambling but he’s stepping up to the table again with a bill that would authorize the Treasury Department to regulate online wagering.

And there’s another shooter in his corner: Jim McDermott , D‑Wash., who sits on the Ways and Means Committee, introduced a bill (HR 2268) that would provide for the collection of associated tax revenues.

Both bills were introduced May 6.
Frank, a Massachusetts Democrat and chairman of the Financial Services Committee, took pains to suggest that his prime motive for introducing his bill was to ensure Americans’ freedom to spend their money as they please.

“The government should not interfere with people’s liberty unless there’s a good reason,” Frank said. But he also acknowledged that, in a time of economic turmoil, the additional revenue wouldn’t hurt.
McDermott’s chief of staff, Mike DeCesare, said that over 10 years, the revenue bill could put $43 billion in federal coffers and even more in states’. It would establish a 2 percent tax on deposits made into Internet wagering accounts.

Undoing Earlier Laws
Frank’s bill would establish a regulatory procedure through which online gambling outfits would have to be licensed in order to accept bets from players in the United States, as long as the state in which a gambler lived did not bar the practice.

This would largely do away with a 2006 law (PL 109-347), pushed through by the Republican leadership as part of a larger port security measure, that was aimed at choking off online betting through restrictions on payment processing.

Robert W. Goodlatte , R-Va., who supports those restrictions, said May 6 that Frank’s measure not only guts that 2006 law but makes online gambling explicitly legal.
“Apparently, Rep. Frank believes that [Treasury Secretary] Timothy Geithner can do a better job at enforcing our nation’s criminal laws than the Department of Justice, which is scary considering [Geithner’s] track record on complying with the tax code,” he said.

The executive director of the Poker Players Alliance, John Pappas, says his 1 million members support Frank’s bill. The group, formed mostly as a grass-roots backlash against the 2006 law, has come into its own; last year it set up a political action committee that contributed $43,553 to congressional campaigns, including $4,950 to Frank’s.


And Pappas’ side now has even greater clout: In a reversal from past battles, Harrah’s Entertainment, one of the largest brick-and-mortar USA casinos gaming companies in the world, has thrown its weight — and its money — behind such legislation. Harrah’s ramped up its lobbying last year, spending more than $405,000 — a large chunk of which was in support of a measure, similar to the one announced May 6, that also was introduced by Frank.

Support for online betting from a company that operates traditional casinos significantly alters the landscape, as such businesses have usually been silent on — or actively opposed to — online wagering, believing it cuts into their bottom line.

“There was some concern from some of the people that are in the offline gaming community. There’s still some,” Frank said. But he pointed to the fact that Shelley Berkley , D-Nev., has signed on as a cosponsor of his bill as evidence of their support.

In the past, Frank’s bills supporting online gambling have been stymied in part by lingering concerns that loosening restrictions on Internet wagering would open the floodgate to a host of social ills. Conservative Christian groups, like Focus on the Family, argue that the 24-hour availability of online gambling makes it particularly easy to develop an addiction. Moreover, the groups contend, online sites make gambling too easy for underage youths.

Frank said he has yet to speak with congressional leaders or the Obama administration about the measure, but he plans to do so soon. The White House did not return calls seeking comment.
At the behest of professional sports leagues, Frank said his legislation would exempt online wagering on sports matches, even though they have long been a favorite of bookies and gamblers alike.

“The expression by the professional leagues of shock at the notion that people would actually bet on games was one of the least persuasive emotional outbursts I have encountered, but we acknowledged the reality of it,” he said. “No one will be betting on professional sports games.”

Minnesota banned sites list includes only 44 casinos that accept players from the U.S.

Speakers Against Online Casino Gaming

Economics professors John Kindt and Earl Grinols are making splashes validating myths and fears about the dangers of online casinos USA, appearing around the US where gaming law changes are debated. The two publish and tour to spread concerns about the social costs of Internet casinos gambling, but their statements do not bear up under examination.

Kindt asserts in the US International Gambling Report Series that areas which introduce casino gambling see double-digit increases in crime and a doubling of problem gambling incidents. As for the wisecrack about Barney Frank, one wit noted, "If Kindt were opposed to that, shouldn't he have fought Fannie Mae and Freddie Mac?"

"Grinols has introduced misleading statistics claiming one of every four teenage Internet gamblers will commit suicide. Kindt uses the volatility of gaming stocks to claim they will ruin the markets. Kindt denies that jobs are created by casinos, all evidence to the contrary to be ignored. Haven't these men discredited themselves to the point media would start ignoring them?" asks OCA analyst Sherman Bradley.

Draft of California online poker bill leaked

As has been rumored for months, California is once again considering whether or not to introduce legislation that would regulate online hold'em poker in the Golden State. But the big mystery right now who is doing the considering.

A piece of draft legislation dated Jan. 15, 2009 and first obtained and posted by IGamingNews, has been circulating around the Internet for a few days.

The carefully drafted legislation details how online poker should be regulated in California. But according to sources with knowledge of the situation, who is actually going to sponsor this legislation is unknown. Democrat Lloyd Levine, who championed the cause last year, is no longer in the California Assembly because of term limits.

The proposed regulatory framework sets up nicely for well-established card rooms like the Bicycle Casino and the Commerce Casino.

In the draft legislation, only "current gaming establishments licensed by the state of California and California tribes with gaming compacts" would be allowed to apply for a California license to offer online poker. It also requires that the "Wagering Hubs," which appear to be a reference to servers, be located in California as well.

Play would be restricted to residents of California with sites required to use an independent third-party service to verify residency and age requirements. The bill sets the casino gambling age at 21.

The proposal also requires that withdrawals from casino betting player accounts be restricted to checks and electronic transfers.

Barney Frank to introduce U.S. online gambling bill next week

Rep. Barney Frank told the Reuters Global Financial Regulation Summit on Tuesday that he would introduce legislation designed to repeal the UIGEA next week.
"We'll be introducing it next week and I plan to move on it," Frank said according to a Reuters report on the story.

Frank, a Democrat from Massachusetts and chairman of the powerful House Financial Services Committee, has long been a champion of the online casino gambling industry.
Last year, Frank introduced two measures designed to overturn the UIGEA. One bill failed to make out of committee. The other was approved by the committee (HFS), but never voted on by the full House of Representatives.

Opposition to Frank's online betting legistlation efforts to overturn the UIGEA is expected to be stiff. The National Football League (NFL) has hired a full-time lobbyist, in part, to help fight the bid to overturn the UIGEA. And social conservatives, like Sen. Jon Kyl and Rep. Spencer Bachus, have indicated they would vigorously fight any attempt to soften or overturn the UIGEA.

New U.S. Internet gambling legislation

News sources have reported that the newest version of Barney Frank’s efforts to bring forth legislation that will regulate USA online casino gambling and overturn the UIGEA in the process will be ushered into the U.S. Congress shortly after Easter.

April 20 is a date that has been reported, but that date has not been confirmed. Frank has only stated that he plans to bring forth the new legislation after the Easter recess, and "definitely in April".

The bill is designed to create a “complete licensing and regulatory framework for the internet gambling industry,” and Frank reportedly wants the bill itself to generate publicity for the cause via “hearings, discussions, and votes.”


As Chairman of the House Financial Services Committee, Frank has a considerable amount of power in the U.S. Congress, and so his desire to focus attention on the issue will likely see fruition.

“Frank has long been a proponent of internet gambling on Capitol Hill,” writes Dan Cypra for Poker News Daily, providing the rundown on events leading to this point. “He was the author of HR 2046, the Internet Gambling Regulation and Enforcement Act, which was introduced in April of 2007, but was not acted upon and now must be reintroduced for consideration. The bill attracted 48 co-sponsors. Last September, the House Financial Services Committee approved HR 6870 by a 30-19 vote, the second version of the Payments System Protection Act, which would have clarified what was legal and illegal under the UIGEA. However, the collapse of the global economy occurred shortly thereafter and the bill was placed on the backburner.”

Party Gaming Settled with USA for $105 Million

After a long period of negotiations and legal maneuvering, Party Gaming has reached a deal with the United States Department of Justice to settle the years-long prosecution against the U.K.-listed online casinos gambling company, the Wall Street Journal reports today.

The deal is being called a "non-prosecution agreement," meaning that the company will pay a sizable fee rather than face any criminal charges. The agreed-upon penalty will take the form of a $105 million fee, reached after nearly two years of discussion and negotiation.

The case has been a controversial one, given the fact that it is essentially prosecuting a non-American company for providing a service with a legality that is difficult to define in clear terms.

"In turn, U.K.-listed Party Gaming has accepted a 'statement of facts' about its business activities prior to the ban, and will pay $105 million in eight installments over a period ending Sept. 30, 2012, from its existing financial resources. The sum is broadly in line with market expectations.

"Under the statement of facts, Party Gaming admits that it offered internet gaming to players in the United States from 1997 to Oct. 13, 2006, which was 'contrary to certain United States laws.'"

Under the terms of this agreement, Party Gaming also agrees to continue to avoid the United States market in the future.

Party Gaming's CEO, Jim Ryan, chose to see the resolution of the years-long case as a positive note, giving his company freedom to pursue new goals. The company will now focus on merger and acquisition activity, according to the article, which went on to predict that the closure of this case represents a turning point for the online gaming industry in general, and may signal a period of market and corporate consolidation.

"We've received a favorable indication from the parties that we'd gone to that once this matter was resolved that we could have access to not only the equity markets, but to debt markets," states Ryan in the article.

U.S.A online casino gambling laws break WTO

As part of a formal investigation, the European Commission has issued a preliminary report that finds USA laws on online casino gambling are legally not justified and discriminatory. The report found that the treatment of foreign online casino betting operators by the USA under existing domestic law constituted a barrier to market access for European companies and is inconsistent with World Trade Organization (WTO) rules. Legislation previously introduced by Rep. Barney Frank (D-Mass.) would resolve the trade dispute by regulating Internet gambling and creating a level playing field among domestic and foreign Internet gambling operators.

"The European Commission inquiry further highlights the need for the Obama Administration and Congress to control Internet gambling not only to protect consumers, but in order to restore integrity to the international trade system," said Jeffrey Sandman, spokesperson for the Safe and Secure Internet Gambling Initiative. "The Obama Administration should seek to forge a new direction on Internet gambling, rather than keeping in place a protectionist trade policy that hypocritically discriminates against foreign online gambling operators."

E.U. Trade Commissioner Catherine Ashton released a statement that encourages the USA to control Internet gambling as a way to address this issue. "It is for the US to decide how best to control Internet gambling in its market, but this must be done in a way that fully respects WTO obligations. I am hopeful that we can find a swift, negotiated solution to this issue," said Commissioner Ashton.

Rt Hon. David Blunkett MP, former U.K. Home Secretary and current Member of the U.K. Parliament joined in calling for USA casino regulation, saying, "I fully support the call by the EU Trade Commissioner, Cathy Ashton, for urgent USA action to regularise the trade relationship, respect WTO rules and to control online gambling. This would provide not only fair competition, but protection for individuals and families, and a legal basis on which substantial revenue could be raised at a time of considerable pressure on public finances."

The inquiry by the European Commission is the result of a Trade Barrier Regulation complaint filed by the offshore Gambling Association (RGA), which represents the largest offshore gambling companies in Europe. In its complaint the RGA claims the United States violates international trade law by threatening and pursuing criminal prosecutions, forfeitures and other enforcement actions against foreign Internet gambling operators, while allowing domestic online casinos USA operators, primarily horse betting, to flourish.

At the conclusion of the investigation, the European Commission could pursue talks with the USA to find an appropriate solution to end the discrimination. If the parties cannot settle the matter themselves, the Commission could bring a case against the USA to the WTO.

A recent analysis found that the USA could receive as much as $51.9 billion in federal revenue over the next decade if Internet gambling is regulated as proposed in legislation previously introduced by Representatives Barney Frank (D-Mass.) and Jim McDermott (D-Wash.).

And for what it might be worth, the United States elected poker-playing President Barack Obama.”

She then moves on to the three key probabilities that anti-UIGEA advocates are most relying upon: President Obama’s power to overturn the Bush administration’s last-minute implementation of UIGEA in 2008; Barney Frank’s commitment to undermining and, if possible, eliminating the law; and the current economic recession that makes any added revenue streams immensely attractive -- including, possibly, revenue that could be gained from taxing a newly regulated online poker industry.

Newell is wise enough to acknowledge that the success of these anti-UIGEA movements will depend heavily on “the unpredictability of politicians and the political process” -- no small factor given the United State’s often contentious and closed-doors lawmaking processes. So, she ends on a note that calls on the players and affiliates to speak up for their rights:

“One major factor that will be necessary to sway the odds in the favor of the Online Poker room industry is the voices of the masses. It is more important than ever that we get involved, especially by letting members of Congress -- and President Obama -- know how we feel.
